Artist’s Resale Right – dossier of damage to small businesses
With the recent extension of Artist’s Resale Right (ARR) in the United Kingdom to the estates of deceased artists, the three trade associations BADA, LAPADA and SLAD, along with the umbrella organisation BAMF, are keen to begin compiling a factual dossier of damage done to art businesses by the enlarged ARR.

The trade bodies have spent many years explaining to both the Government and the European Commission the harm which ARR will do to the British and European art markets.  Dealers find it increasingly hard to meet their overheads in the current climate and for small businesses 4% ARR on purchase plus 4% ARR on sale, combined with the paperwork required, can be the straw which breaks the camel’s back.

For example you may know of dealers who have had to close their business sooner than expected because of the extra costs involved, who have ensured that a particular large transaction takes place outside the United Kingdom, who have moved their businesses outside the European Union, or who have stopped purchasing particular genres of art work.
